Acciona Construction USA, Corp., on behalf of its joint venture, SR400 Constructors, is currently looking to hire a Junior Attorney to assist in construction contracts and negotiations for our project office in Alpharetta, GA. The Junior Attorney will support the Project Counsel as part of the Legal Office for the State Route 400 Express Lanes Project (the "Project") in Atlanta, Georgia, which is a P3 project, involving the design, build, finance, operation, maintenance and tolling of new express lanes in both directions along a 16-mile section of SR 400 from the North Springs MARTA Station (Exit 5C) in Fulton County to approximately 1 mile north of McFarland Parkway (Exit 12) in Forsyth County.
Job Description
Gain a deep understanding of the key project contracts (prime contracts, major subcontracts, and purchase orders). This includes, among other things, acquiring familiarity with: (i) notice procedures and deadlines; (ii) contractual risk allocation; (iii) invoicing and payment provisions; (iv) contractual remedies and preconditions to obtaining relief; and (v) dispute escalation and resolution sequence.
Assist in reviewing subcontracts, identifying impact of proposed changes, and discernment of issues and appropriate solutions to reach solutions beneficial to the Project while managing risk.
Assist in drafting project correspondence to be sent to the owner, key subcontractors and critical third parties. Gather the necessary technical or commercial data necessary for the specific piece of correspondence in question. Seek input, review and approval from the Project Counsel.
Support the Project Counsel and project management team in creating the necessary awareness in all key personnel at the project so that issues which may require contractual response are identified and communicated in a timely fashion.
Maintain good practices with regards to internal communications (internal memos, e-mails between team members). Ensure good practices to that effect are followed.
Assist in the identification and preparation of claims in close coordination with project management team. Management of disputes and claims.
Support the Project Counsel when addressing insurance claims and coverage issues related to the Project on an as needed basis.
Assist in reviewing solicitations (RFQs, RFPs) to be issued to vendors (subcontractors, suppliers, etc.).
Review and provide written analysis and legal opinion regarding any adjustments made to contracts and ensuring that the specifications comply with agreements made.
Provide open and transparent communications with and functional reporting to the Project Counsel and willingness to take direction.
Perform other related duties as required and assigned.
Required Skills and Competencies
Bachelor’s degree and Juris Doctorate required.
0 - 2 years of law firm or in-house experience. Experience in construction, contracts and negotiation is a plus.
Admitted to the Bar (license to practice law) required, preferably in Georgia.
Proficiency with Microsoft Office Suite, Word, Excel, and Outlook is required.
Team player with strong communication skills, reporting skills, analytical skills, negotiating skills and organizational capabilities.
Familiarity with contract documents and contract law.
